Craig Kunkes

Craig’s practice focuses on business litigation in federal and state courts as well as matters relating to administrative and government law. Craig represents plaintiffs and defendants in a wide range of complex disputes, including business tort, real estate, business divorce/partnership and fiduciary, trust and estate, RICO, and restrictive covenant litigation. He also has significant administrative and government law experience, including representing clients who were investigated by the Governor’s Office of Consumer Protection for alleged violations of the Fair Business Practices Act and representing clients with regard to campaign finance matters.

Prior to joining the firm, Craig served as an attorney for the Georgia Governor’s Office of Consumer Protection and as counsel to the Georgia House of Representatives Judiciary Non-Civil Committee. At the Office of Consumer Protection, Craig led the investigations of a variety of businesses and individuals to determine whether they violated consumer protection laws and regulations. He successfully negotiated a number of public settlements, including one for over $4.3 million.

Craig earned his law degree from Vanderbilt University Law School, where he received the Vanderbilt Scholastic Excellence Award in Legal Writing. He graduated Phi Beta Kappa and summa cum laude from Tufts University, where he played on the varsity tennis team. Craig is active in a number of charitable and political organizations.

Representative Matters

  • Successfully defended the managing member of a real estate investment LLC from personal guaranty, fraud, and promissory estoppel claims which sought over $1.5 million from our client. The summary judgment order in favor of our client was affirmed by the Georgia Court of Appeals.
  • Represented clients in responding to investigations by the Governor’s Office of Consumer Protection, which is now known as the Georgia Department of Law Consumer Protection Unit, for alleged violations of the Fair Business Practices Act.
  • Represented a client involved in a business divorce. This case settled pursuant to a confidential settlement agreement.
  • Obtained the dismissal (judgment as a matter of law) of an unjust enrichment claim seeking over $4 million from our clients during a trial in federal court.
  • Represented the Governor’s Office of Consumer Protection in the investigation of a Fortune 500 telecommunications company for alleged false advertising which resulted in a $600,000 settlement for the State of Georgia.
  • Represented an individual who sued his CPA after an employee of the CPA firm admitted to stealing money from an escrow account. The case settled pursuant to a confidential settlement agreement.
  • Represented a client who challenged the enforceability of a restrictive covenant in an employment contract with his former employee under Georgia’s revised restrictive covenant statutes. This case settled pursuant to an agreement that allowed our client to continue to work for his new employer.
  • Represented a commercial landlord in a dispute with a tenant regarding the parties’ obligations pursuant to a lease. This case settled pursuant to a confidential settlement.
  • Represented clients in successful appeals of matters that were handled by other law firms in the trial court.
